These Terms & Conditions ("Terms") govern your access to and use of the ChopsCity platform, mobile app, and related services (collectively, the "Service") provided by ChopsCity Express Ltd ("ChopsCity", "we", "us", or "our"). By creating an account or placing an order, you agree to be bound by these Terms. If you do not agree, do not use the Service.
ChopsCity Express Ltd is incorporated in the Federal Republic of Nigeria under the Corporate Affairs Commission (CAC), with its registered office in Lagos State, Nigeria.
1. Eligibility & Account Registration
You must be at least 16 years old to use ChopsCity. By using the Service you confirm that you meet this requirement.
When you register, you agree to:
- Provide accurate, current, and complete information
- Keep your password confidential and not share it with anyone
- Notify us immediately at support@chopscity.com if you suspect unauthorised access to your account
- Take responsibility for all activity that occurs under your account
2. The ChopsCity Service
ChopsCity operates as a marketplace connecting customers with independent food vendors and delivery riders within supported cities. We facilitate orders and payments but we are not a restaurant or food producer. The preparation and quality of food is the sole responsibility of the vendor.
Service availability is city-by-city. ChopsCity launches and operates one city at a time. Delivery, vendor discovery, and all location-based features are only available within the boundaries of cities where the Service has been activated. The app displays your current supported coverage area. ChopsCity is not liable for any inability to use the Service outside a currently active city.
We reserve the right to add new cities, adjust coverage boundaries, or withdraw from a city at any time.
3. Orders, Pricing & Payment
3.1 Placing an Order
When you place an order you make an offer to purchase from the vendor. The order is confirmed only when you receive an in-app or email confirmation. Vendors may decline orders at their discretion, in which case you will receive a full refund.
3.2 Pricing
Prices displayed are set by vendors and include applicable taxes where shown. ChopsCity may charge a service fee and/or delivery fee, which will be clearly shown at checkout before you confirm your order. Prices and fees may change without prior notice.
3.3 Payment
All payments are processed by our third-party payment providers. By placing an order you authorise us to charge your selected payment method for the full order amount. ChopsCity does not store raw card details — payment data is handled end-to-end by the payment processor.
If a payment fails, your order will not be processed. In the event of an erroneous charge, contact support@chopscity.com within 7 days.
4. Delivery
4.1 Estimated Times
Delivery time estimates are provided by vendors and riders and are not guaranteed. Factors such as traffic, weather, and order volume can affect delivery times. ChopsCity is not liable for delays.
4.2 Delivery Address
You are responsible for providing a correct and accessible delivery address within the active service area. ChopsCity and riders are not liable for failed deliveries caused by an incorrect address, an inaccessible location, or a location outside the active coverage zone.
4.3 Receipt of Order
Once an order is marked as delivered in the app, responsibility passes to you. If you believe an order was not delivered or was delivered incorrectly, contact us within 24 hours.
5. Cancellations & Refunds
5.1 Cancellations by You
You may cancel an order without charge within a short window after placement (shown in the app), provided the vendor has not yet accepted or started preparing your order. Once preparation has begun, cancellation may not be possible or a cancellation fee may apply.
5.2 Cancellations by Vendors
If a vendor cancels your order (e.g., item unavailable, vendor closed), you will receive a full refund to your original payment method within 3-5 business days.
5.3 Refunds & Complaints
If your order is incorrect, has missing items, or is of unacceptable quality, contact support@chopscity.com within 24 hours of delivery with your order number and supporting photos. We will investigate and, where appropriate, issue a full or partial refund or credit. Refund decisions are at ChopsCity's discretion.
6. Vendor & Rider Relationships
Vendors and riders on the ChopsCity platform are independent parties, not employees, agents, or partners of ChopsCity. ChopsCity is not responsible for the actions, omissions, food quality, hygiene standards, or conduct of vendors or riders. Any disputes with a vendor or rider should be reported to us, but ChopsCity's role is limited to facilitating a resolution.
7. Food Allergens & Dietary Requirements
This is important — please read carefully.
ChopsCity is a marketplace platform. Menu descriptions, ingredient lists, and nutritional information displayed in the app are provided entirely by individual vendors. ChopsCity does not independently verify, audit, or guarantee the accuracy of any allergen, ingredient, or nutritional information.
- If you have a food allergy, intolerance, or specific dietary requirement (including but not limited to nuts, gluten, dairy, shellfish, eggs, soy, or sesame), always contact the vendor directly before placing your order to confirm ingredients and preparation methods.
- Cross-contamination may occur during food preparation. Vendors prepare food in shared kitchen environments and cannot always guarantee allergen-free conditions.
- Do not rely solely on the information shown in the app to make decisions about your dietary safety.
- ChopsCity expressly disclaims all liability for allergic reactions, adverse health effects, or dietary harm arising from the consumption of food ordered through the Service.
8. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation
- Place fraudulent orders or provide false information
- Abuse, harass, threaten, or intimidate vendors, riders, or ChopsCity staff
- Attempt to gain unauthorised access to any part of the Service or its infrastructure
- Reverse engineer, scrape, or copy any part of the Service
- Post or transmit content that is defamatory, obscene, harmful, or infringes third-party rights
- Manipulate ratings or reviews
9. User Content
You may submit reviews, ratings, photos, and other content ("User Content") through the Service. By submitting User Content you grant ChopsCity a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and distribute that content in connection with the Service.
You are solely responsible for User Content you submit and confirm that it is accurate, does not infringe any third-party rights, and does not contain unlawful or harmful material. We reserve the right to remove any User Content at our discretion.
10. Intellectual Property
All content on the ChopsCity platform — including logos, graphics, software, and text — is owned by or licensed to ChopsCity Express Ltd and is protected by applicable intellectual property laws. You may not use, copy, or distribute any ChopsCity content without our prior written consent.
11. Disclaimers
To the fullest extent permitted by Nigerian law:
- The Service is provided "as is" and "as available" without warranties of any kind, express or implied
- We do not warrant that the Service will be uninterrupted, error-free, or free of viruses
- We do not warrant the accuracy or quality of information provided by vendors
- Service availability is limited to active cities; we make no representation that the Service will be available in any particular location
12. Limitation of Liability
To the fullest extent permitted by applicable Nigerian law, ChopsCity Express Ltd and its directors, employees, and affiliates shall not be liable for:
- Indirect, incidental, consequential, or punitive damages
- Loss of profits, revenue, data, or goodwill
- Damages arising from vendor food quality, allergen exposure, rider conduct, or delivery delays
- Any loss exceeding the amount you paid for the specific order giving rise to the claim
13. Indemnification
You agree to indemnify and hold harmless ChopsCity Express Ltd and its officers, employees, and agents from any claims, losses, liabilities, damages, and expenses (including legal fees) arising out of your use of the Service, your User Content, or your breach of these Terms.
14. Governing Law & Disputes
These Terms are governed by the laws of the Federal Republic of Nigeria. Any dispute arising out of or relating to these Terms or the Service that cannot be resolved informally shall be submitted to the exclusive jurisdiction of the Nigerian courts.
We encourage you to contact us first at legal@chopscity.com — most issues can be resolved quickly without formal proceedings.
15. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via the app or by email at least 7 days before they take effect. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Service after the effective date constitutes your acceptance of the updated Terms.
